Welcome to SimplySplit! These Terms of Service ("Terms") govern your access to and use of the website www.simplysplit.ca (the "Site") and the uncontested divorce document preparation services offered by SimplySplit Inc. ("SimplySplit", "we", "us", or "our") (the "Services").

Please read these Terms carefully before using our Site or Services. By accessing the Site or purchasing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site or Services.

1. Description of Services

SimplySplit provides a non-lawyer document preparation service for individuals seeking an uncontested desk-order divorce in the province of British Columbia, Canada. Our Services involve:

  • Providing access to an online questionnaire ("Intake Questionnaire") designed to gather information relevant to an uncontested divorce.

  • Using the information you provide in the Intake Questionnaire to populate standard British Columbia Supreme Court forms required for an uncontested divorce application.

  • Delivering the populated forms to you electronically in PDF format.

2. NO Legal Advice Provided

SimplySplit is NOT a law firm. We do not provide legal advice, legal representation, or legal services of any kind. Our employees are not lawyers and are not acting as your lawyer. The Services are limited to document preparation based solely on the information you provide.

Using our Services is not a substitute for consulting with a qualified family lawyer. We do not offer opinions on your legal rights, remedies, defenses, options, or strategies. We cannot tell you what information to include in the forms beyond what is requested, nor can we advise you on the legal consequences of the information you provide or the agreements you have made with your spouse.

We provide general information about the uncontested divorce process in BC for informational purposes only, which should not be construed as legal advice. You are solely responsible for ensuring the information you provide is accurate and complete, and for understanding the legal implications of your divorce.

If you require legal advice or representation, you must consult with a licensed lawyer in British Columbia.

3. Eligibility and User Responsibilities

To use our Services, you must:

  • Meet the residency and separation requirements for an uncontested divorce in British Columbia (generally, at least one spouse resident in BC for one year prior to filing, and separated for at least one year).

  • Be seeking an uncontested divorce, meaning you and your spouse agree on all essential terms (divorce, property/debt division, support, child arrangements).

  • Provide accurate, complete, and truthful information through our Intake Questionnaire.

  • Review the documents prepared by SimplySplit carefully for accuracy based on the information you provided.

  • Be solely responsible for printing, signing, filing the documents with the appropriate BC Supreme Court registry, paying all applicable court filing fees, and arranging for proper service of documents on your spouse if required by court rules.

  • Agree not to use our Services for any fraudulent or unlawful purpose.

4. Payment and Fees

  • Our fees for the Services are presented as flat-rate packages on our Site.

  • Payment is due in full before we begin preparing your documents.

  • Payments are processed securely through our third-party payment processor, Stripe. By providing payment information, you authorize us (via Stripe) to charge the applicable fees.

  • Our fees cover document preparation only and do not include court filing fees or any other third-party costs.

  • Refunds: Due to the nature of the service and the immediate commencement of work upon payment and submission of intake information, fees paid for our Services are generally non-refundable once document preparation has begun. Please review our package descriptions carefully before purchasing.

5. Document Delivery and Turnaround Time

We strive to deliver your prepared documents electronically (via email as PDFs) within 5 business days after we receive your fully completed Intake Questionnaire and confirmation of payment. Delays may occur if the information provided is incomplete or requires clarification.

6. Intellectual Property

The Site, its content (excluding user-provided information), features, functionality, and the underlying processes and software used to provide the Services are owned by SimplySplit Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Site or Services without our express written permission.

The prepared documents delivered to you are for your personal use in your divorce proceeding only.

7. Disclaimers

  • THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • SIMPLYSPLIT DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THE PREPARED DOCUMENTS WILL BE ERROR-FREE IN ALL RESPECTS (ALTHOUGH WE STRIVE FOR ACCURACY BASED ON YOUR INPUT), OR THAT THE DIVORCE WILL BE GRANTED BY THE COURT (AS THIS IS AT THE COURT’S DISCRETION).

  • WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY GENERAL INFORMATION PROVIDED ON THE SITE REGARDING THE DIVORCE PROCESS.

  • YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR THE ACCURACY OF THE INFORMATION YOU PROVIDE AND FOR ALL ACTIONS TAKEN WITH THE PREPARED DOCUMENTS (INCLUDING FILING AND SERVICE).

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIMPLYSPLIT INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;

  • (b) ANY ERRORS OR OMISSIONS IN THE DOCUMENTS PREPARED BASED ON INACCURATE OR INCOMPLETE INFORMATION PROVIDED BY YOU;

  • (c) ANY DELAYS IN THE DIVORCE PROCESS OR REJECTION OF DOCUMENTS BY THE COURT;

  • (d) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE;

  • (e) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL SIMPLYSPLIT’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT YOU PAID SIMPLYSPLIT FOR THE SERVICES IN QUESTION.

9. Indemnification

You agree to defend, indemnify, and hold harmless SimplySplit Inc. and its directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or Services, including, but not limited to, any claim arising from inaccurate or incomplete information provided by you.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site and update the "Effective Date" at the top. Your continued use of the Site or Services after the effective date of the revised Terms constitutes your acceptance of the changes.

12. Termination

We may terminate or suspend your access to the Site or Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
